Building owners are legally required to provide heat and hot water to their tenants. Hot water must be provided days per year at a constant minimum temperature of degrees Fahrenheit.
Heat must be provided between October 1st and May 31st, i. Between the hours of am and pm, if the outside temperature falls below 55 degrees, the inside temperature is required to be at least 68 degrees Fahrenheit. Between the hours of pm and am, the inside temperature is required to be at least 62 degrees Fahrenheit. If you are a tenant without heat or hot water, contact your landlord first. This is the easiest way to resolve a housing quality issues. If your landlord is unresponsive, file a complaint.
If a tenant files a complaint related to heat or hot water, HPD attempts to notify the building owner or managing agent and may also attempt to contact the tenant to see whether service has been restored.
If service has not been restored, an HPD inspector will go to the building to verify the complaint and issue the appropriate violation. If an owner fails to restore heat and hot water after receiving a violation, HPD's Emergency Repair Program ERP may contract with private companies to restore essential services and bill the owner for the cost of the repairs, plus related fees.
The City is subject to laws governing procurement, contracting, and wages that may make such work significantly more expensive than the price the owner could obtain themselves. If the property owner fails to pay, the City will file a tax lien against the property. HPD typically starts a court proceeding for all issued heat violations and some hot water violations.
The agency can seek the following penalties, effective on the posting date of the Notice of Violation until the date that the violation is corrected:. If the owner fails to pay the Court ordered civil penalties, HPD will enter a judgment against the owner and the property and seek to enforce that judgment. The Notice of Violation will clearly indicate whether the violation is eligible for payment in satisfaction of civil penalties, based on whether the heat violation is the first such violation of the current or prior heat season, or the hot water violation is the first such violation of the current or previous calendar year.
An owner who chooses to submit a Notice of Correction and payment in satisfaction may do so by mail or by using eCertification. If the Notice of Correction and payment are not received within the 10 day period, HPD may pursue an order to correct and civil penalties in Housing Court.

The report, commissioned by NRDC from VEIC, a nonprofit sustainable energy consulting organization, models an ambitious yet achievable scenario in which clean heating and cooling technologies could be installed in over 5 million buildings by The VEIC analysis shows, heat pump installations could achieve at least 31 TBtu of energy savings in that time, or 17 percent of the target.
Heat pump electrification replaces heating systems that use natural gas, propane, or fuel oil with either air-source pumps or ground-source pumps. More on how heat pumps work here. As the electric transmission system moves more pollution-free electricity to our homes and businesses, the climate advantage of heat pumps compared to burning fuel in a gas or oil system will only grow.
Ultimately, heat pumps powered by a largely renewable energy grid will provide near-zero carbon heat and hot water in buildings, and play a central role in efforts to meet economywide climate goals. Examples of heat pump incentive programs include rebates for reducing installation costs to residential customers, incentives for accelerating equipment sales, and training installers.
Most importantly, New York should establish a statewide target of 30 TBtu of energy savings from heat pump installations by that counts savings achieved across all fuels including reductions in total energy used from electricity, gas, and oil. As the report notes, several existing programs encourage heat pump adoption in New York—such as customer incentives offered by utilities and community-based partnerships focusing on workforce training and increased participation of lower-income households.
These programs must be expanded and carefully coordinated to achieve the 30 TBtu target. It will necessitate clearly communicated, cost-saving options for customers and suggests more study is needed on policies to make heat pump options as affordable as possible. Utilities are well-positioned to lead in engaging with customers and providing customer incentives.
Additionally, the New York Green Bank is an important partner for supporting customer financing options. However, electrification is a means to cost-effective decarbonization, not an end. It must be closely integrated with broader efficiency efforts, presented as a suite of policies to use electricity more strategically in order to maximize its potential benefits for the environment, customers, and the grid.
This is an opportunity too promising to pass up. In a timely move in these times of historic wildfires and smoky days, California has taken a big step toward reducing carbon emissions and air pollution from heating and hot water in homes and buildings.
